These terms govern your use of the SerpWatch desktop app and the website at serpwatch.smartcognis.com (together, the Service), provided by SerpWatch (company name TBD) ("we", "us"). By creating an account or using the Service you agree to these terms. If you do not agree, please do not use it.
1. The Service
SerpWatch tracks where your website appears in Google search results for the keywords you choose, and shows positions, changes and history. The desktop app can be used on the free plan without an account. An account is needed to buy and use a paid plan.
2. Your account
- You must give a valid email address and keep your password confidential. You are responsible for activity under your account.
- You must verify your email address before you can buy a plan.
- Each plan allows a limited number of devices. You can remove a device from your dashboard at any time.
- You must be at least 16 years old, or the age of digital consent in your country if that is higher.
3. Plans, billing and cancellation
- The Free plan costs nothing. Paid plans (currently Pro and Max) are subscriptions billed monthly or yearly, as you choose, in euros, at the price shown on the pricing page when you subscribe.
- Payments are processed by PayPal. We never see or store your card or PayPal login details.
- A subscription renews automatically at the end of each billing period (each month or each year) until you cancel it. You can cancel at any time from your dashboard or in your PayPal account. After cancelling you keep your plan until the end of the period you already paid for, and it does not renew.
- If a renewal payment fails, PayPal may retry it. If it keeps failing the subscription ends and your account returns to the Free plan.
- Unless the law requires otherwise, payments for a period that has already started are not refundable. If you believe you were charged in error, contact us.
- We may change prices or plan limits. A price change applies from your next renewal after we tell you in advance, and you may cancel before it takes effect.
- Taxes such as VAT may be added where required.
4. Using the Service
You agree not to:
- use the Service unlawfully, or to harm, overload or disrupt it or other people;
- try to access accounts, data or systems that are not yours, or work around plan limits or device limits;
- resell or sublicense the Service, or reverse engineer or copy the app, except where the law allows it;
- use the Service to send spam or to infringe anyone else's rights.
5. How rank checks work
Positions come from searches made on Google. Results can differ by country, device, language, personalisation and time, so the positions we show are an indication and may not match what every visitor sees. Google is a third party; we are not affiliated with it and its own terms apply to its service. We cannot guarantee that Google will always return results or that a check will succeed.
Use of your computer and connection
To keep rank checks working for all users, the app may carry out search requests sent by our servers, using your computer and internet connection, while it is running and connected. Those searches are about keywords chosen by us or other users, not about your own activity, and the app sends back only the search results. The app can be closed at any time to stop this.
6. Your data
Your keyword list and ranking history are kept on your own computer by the app. How we handle personal data is described in our Privacy Policy.
7. Intellectual property
The Service, including the app, the website and their design, belongs to SerpWatch (company name TBD) and its licensors. We give you a personal, non-exclusive, non-transferable licence to use the app for its intended purpose while these terms apply. You keep ownership of your own data.
8. Availability and changes
We work to keep the Service available but do not promise it will be uninterrupted or error-free. We may update, change or discontinue features, and we will give reasonable notice of changes that significantly reduce a paid plan. We may release app updates, and some updates may be needed to keep the Service working.
9. Disclaimer and liability
The Service is provided "as is" and "as available". To the fullest extent the law allows, SerpWatch (company name TBD) is not liable for indirect or consequential losses, lost profits or lost business arising from your use of the Service, and our total liability for any claim is limited to the amount you paid us for the Service in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence or for fraud, and consumers keep the rights they have under mandatory consumer law.
10. Suspension and ending
You can stop using the Service and delete your account at any time from your profile. We may suspend or end access if you seriously or repeatedly break these terms or misuse the Service, and will tell you why where we can. When an account ends, the right to use the paid features ends too.
11. Changes to these terms
We may update these terms. When the change is significant we will tell you, for example by email or in the app, before it applies. Continuing to use the Service after a change means you accept it.
12. Governing law
These terms are governed by the laws of [country TBD], and the courts there have jurisdiction, without taking away any rights you have as a consumer under the mandatory law of the country where you live.
